Summary: When an 84-year-old woman was found stabbed to death in her Bedford home on Jan. 25, 1991, attention quickly turned to ex-cons whom she had befriended as part of a prison ministry program. One of them, Allen, had kept up a friendship with her after being paroled in 1989.
Available DNA evidence: bloody gloves left at the scene, Allen's blood-spotted jacket
Rationale for testing: Inconclusive DNA testing of the gloves in July 2007 didn't use the latest available methods. Also, the testing showed that a spot of blood on Allen's jacket is not the victim's, as the jury was told.

Why This Is Important
Abdul Awkal was convicted of the 1992 murders of Latife Awkal and Mahmoud Abdul-Aziz. We urge Governor Kasich to consider the following and commute Abdul’s death sentence to life without parole:
• His trial counsel was ineffective for calling a psychiatrist who contradicted the defense’s theory.
• During the penalty phase, counsel failed to provide records of his previous involuntary hospitalization or to present testimony from competent mental health experts.
• There was prosecutorial misconduct in the closing statement, which may have influenced jury members prior to their deliberations.
We deeply sympathize with the family and friends of Latife Awkal and Mahmoud Abdul-Aziz, but we respectfully offer that another death will neither heal nor resolve this tragedy.
Action petitioned for: We, the undersigned, are concerned citizens who urge Governor Kasich to commute the sentence of Abdul Awkal to life without parole.

Previous Information

Awkal Gets New Trial

The majority of the Sixth Circuit panel (Moore, Cole, Gilman dissenting) in Awkal v. Mitchell, 01-4278, reversed the district court's denial of habeas relief and granted a new trial on the basis of ineffective assistance of counsel at the guilt phase. Awkal presented claims for relief on IAC during the guilt phase, IAC during sentencing, and prosecutorial misconduct. The panel did not decide the other two claims, but focused only on the question of whether counsel was ineffective for calling an expert witness who testified unequivocally that Awkal was sane at the time of the murder, when Awkal's entire defense was that he was not guilty by reason of insanity.

Counsel presented testimony of three experts: one whose testimony was stricken because he was not licensed in Ohio (and he had received his degree by mail); another who was a pediatrician who had practiced psychiatry for less than one year and was not yet certified; and the third, Dr. Rizk, who had conducted Awkal's pretrial sanity and competency evaluations for the court. The majority noted that counsel was in possession of Dr' Rizk's report well before he testified and should have known that it would be damaging. The majority analogized the case to Combs v. Coyle, 205 F.3d 269 (6th Cir. 2000), in which the court found ineffective assistance of counsel where counsel presented expert testimony that eviscerated the petitioner's intoxication defense. It found that Rizk's testimony so devastated Awkal's defense that it was objectively unreasonable for his counsel to call him as a witness. Regarding the prejudice prong, the majority held that the damage done by this witness was so obvious and extensive that had counsel not called him, there was a reasonable probability that the jury's verdict would have been different. In its AEDPA analysis, it further found that the Ohio Supreme Court's application of Strickland was objectively unreasonable in that the court failed to take into account the obvious harm caused by counsel's decision.

Judge Gilman, in dissent found that while counsel's decision was questionable, it was not outside the wide range of professionally competent assistance. It was clear that counsel had made a conscious decision to present this damaging testimony and so it must have been part of the "strategy." As to the prejudice prong, Judge Gilman found that the evidence against Awkal being psychotic at the time of the murders was so overwhelming, that he had no chance at an insanity defense even without Dr. Rizk's testimony

Some of the reasons for clemency were;

Mr. Bedford was mentally retarded but was convicted before the U.S. Supreme Court ruled that the Constitution bars the execution of a mentally retarded person. No court had ever heard his evidence supporting this claim.


Mr. Bedford had other severe mental impairments. He had significant memory problems and did not remember events like his father's murder when he was a child and his own trial

Recently, his condition had deteriorated even further as a result of dementia and other health conditions, including seizures, fainting spells, head trauma, and stroke-like brain injuries. These impairments had led to a life long struggle with the most basic concepts necessary to function on a day-to-day basis and continue to prevent Mr. Bedford from helping his attorneys save his life

Sentence: death
Summary: When a Cleveland man answered a knock at the door, he was led back inside at gunpoint, shot twice and repeatedly pummeled. The victim's two roommates saw the attack on Nov. 28, 1987, and called police. That night, Bonnell was arrested for drunken driving and fleeing police, and later was charged with the murder.
Available DNA evidence: blood and vomit from the scene, swabs from Bonnell's hands, the murder weapon. The prosecutor, however, says the evidence is gone but hasn't provided details.
Rationale for testing: Unbeknownst to Bonnell's lawyer, the victim's roommates originally described the attacker as a stranger even though both knew Bonnell. They later testified against Bonnell, with one avoiding jail time as part of a plea bargain, not revealed at trial, for an unrelated violent assault.

• Everyone agrees that Reginald suffered from schizophrenia before, during, and after murders:


• He also suffers from paranoia and believed his wife and co-workers tried to poison him, accused his wife of having an incestuous relationship with their oldest son, believed in voodoo and mutilated dolls, and refused to allow his oldest son to display athletic trophies and was under severe stress.

• In addition, Reginald suffered from psychogenic amnesia and was unable supply some important information to his lawyer.

• Reginald’s lawyers did not thoroughly interview family members, friends or mental health experts who could have provided additional information about his mental state.

• Reginald Brooks has been on Ohio’s Death Row since 1984. Clearly he can safely kept away from society.

We deeply sympathize with family and friends of the Brooks children, but we respectfully offer that another death will neither heal nor resolve this tragedy.
